We will render service to the equipment under the contract period, during our normal working hours unless otherwise specifically agreed to.

Risk Protection Contract

• Free replacement of defective/worn-out parts with new or serviceable parts such as refrigeration system, compressor, electrical components and controls, fan motors, fan blades, insulation air filter and knobs as and when required.
• Overhauling at site or in Service Station as required.
• Free transport to the Service Station and back in case the equipment is required to be taken to the Service Station; only for the equipment installed within city limits.
• Loan of a service unit subject to availability only for the period when the equipment is under repairs in the Service Station. We however retain the right to withdraw the service unit at any time. Property rights on the service unit shall remain ours at all times.

Abnormal usage/misuse/unauthorized attendance

• Failure of equipment due to supply voltage beyond permissible range.
• All defects in your electrical installation or abnormal usage or usage other than the equipment is originally designed for are not covered by this order.
• Danger to life and performance of equipment close to direct or indirect heat source acidic fumes reactive chemicals, powders and non-ventilated areas.
• Tampering with and repairs of the equipment at any time under any circumstances whatsoever by anyone other than our authorized representative, the contract will be considered null and void

Exclusions

• Sheet metal parts and painting
• Back cover and front grille for room air-conditioner
• Replacement of Condenser and Evaporator Coils.

Taxes and Duties

Increase in taxes, levies or rates imposed by the State or Central Government or local authority or any fresh levies imposed by such authorities on components, raw material or installation as a whole after the date of offer and during the contract/ for any reason whatsoever will be paid by the customer.

Special Note

While we clean the air filter during our preventive services, the same should be cleaned by customer more frequently depending on usage.

If the installation is outside city limits/at overhead level/having difficult accessibility/in the area having environmental pollution it will attract special price.

Change of Ownership or Location

The Contract is not transferable and we reserve the right to terminate the contract in case of change of ownership or location of the equipment. On such termination there will be no refund of contract fee unexpired period for the contract.

Limitation To Liability

• In no event shall we be liable for any consequential loss or damage arising out of or connected with this contract in anyway whatsoever.
• We will not be liable for damage or destruction of any part or parts of the equipment which may occur during the process of handling unless it is proved that the same was owing to any wrongful act or negligence on the part of our servicemen.

Force Majeure

No liability shall be attached to us non-performance or delayed execution of this contract as a result of force Majeure.

Arbitration

All disputes and differences arising out of or connected with this contract, failing amicable settlement shall be referred to the arbitration. One to be appointed by each party. The arbitrators shall appoint an umpire before proceeding with Arbitration under the Arbitration Act 1940 or any modification thereof, for the time being in force. Arbitration shall take place in the city from which this offer is issued.

Validity

The offer is valid for one month from its date of issue.
